Subscription to the services and access to the service are carried out exclusively via the mobile application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bloom &amp; Fly service is accessible exclusively through the corresponding mobile application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The service consists of making available digital content and features dedicated to well-being and personal balance, including in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>guided breathing exercises,<\/li>\n\n\n\n<li>mantras and affirmations,<\/li>\n\n\n\n<li>mudras,<\/li>\n\n\n\n<li>quick rituals,<\/li>\n\n\n\n<li>guided journeys,<\/li>\n\n\n\n<li>musical ambiances,<\/li>\n\n\n\n<li>and personalisation features for certain practices.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The content is provided for general well-being purposes only and does not constitute medical, therapeutic or healthcare services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The content and features of the service may evolve, be enriched or modified at any time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 4 \u2013 User account creation<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to the services requires the creation of a user account within the Bloom &amp; Fly application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client undertakes to provide accurate and up-to-date information when creating the account and to keep their login credentials confidential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps reserves the right to suspend or delete an account in the event of non-compliance with these GTC or abusive use of the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 5 \u2013 Subscriptions and pricing<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to the premium features of the Bloom &amp; Fly service is offered through paid subscriptions, including monthly and annual plans, the prices of which are displayed directly within the application at the time of subscription.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are displayed in accordance with the rules of the distribution platforms as well as the regulations in force in the user\u2019s country. Depending on applicable laws, prices may be shown inclusive or exclusive of taxes. Where applicable, taxes will be added at the time of payment. The applicable tax rates are those in effect at the time of the transaction and may change in accordance with local regulations. Any changes in tax rates will be automatically reflected in the final price paid by the user. Bloomy Apps shall not be held responsible for any bank fees that may be applied by the user\u2019s payment provider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps reserves the right to modify its pricing at any time, without affecting ongoing subscriptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 6 \u2013 Ordering process<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client downloads the Bloom &amp; Fly mobile application from an official distribution platform (Apple App Store or Google Play Store).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After creating or logging into their user account, the Client selects a monthly or annual subscription directly within the Bloom &amp; Fly mobile application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The order is confirmed when the Client validates the purchase via the relevant distribution platform, after having read and accepted these GTC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment is debited immediately by Apple or Google, depending on the platform used.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to premium services is automatically activated on the Client\u2019s account following payment validation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client receives confirmation of the purchase via the email sent by the relevant distribution platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 7 \u2013 Payment terms<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payments are made exclusively via the Apple App Store and Google Play Store platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accepted payment methods are those offered by the relevant platforms (credit card, PayPal, or any other method made available by them).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps does not intervene in the payment process and does not collect any banking data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 8 \u2013 Duration, renewal and termination<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subscriptions are entered into for a duration of one month or one year depending on the plan selected by the Client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are automatically renewed for an identical period at the end of each term, unless cancelled by the Client via the relevant distribution platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cancellation of a subscription must be carried out exclusively via the App Store or Google Play Store, in accordance with the conditions of those platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client is invited to cancel the subscription sufficiently in advance of the renewal date, in accordance with the deadlines and procedures indicated by the relevant platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deletion of the Bloom &amp; Fly user account does not automatically result in cancellation of the subscription.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 9 \u2013 Provision of services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The services are provided in the form of a digital service accessible via the Bloom &amp; Fly mobile application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The services are provided immediately after payment validation by the relevant distribution platform, or within a maximum period of twenty-four (24) hours.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event that access to the services is not possible within a reasonable period following payment validation, and after prior notification of the malfunction to customer support, the Client may request cancellation of the order if no solution has been provided within a maximum period of seven (7) days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 10 \u2013 Technical requirements and access to the service<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to the Bloom &amp; Fly service requires an internet connection, a compatible device (smartphone or tablet), and an up-to-date operating system. The Client is responsible for their equipment, internet connection, and any communication costs associated with use of the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Proper functioning of the service may depend on technical constraints related to the Client\u2019s device, operating system, internet connection, as well as the Apple App Store and Google Play Store platforms. Bloomy Apps shall not be held liable for malfunctions attributable to these external elements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 11 \u2013 Complaints<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any complaint relating to the operation of the service must be sent by email to the following address:\u00a0&nbsp;<a href=\"mailto:contact@bloomandflyapp.com\">contact@bloomandflyapp.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The maximum period for submitting a complaint is thirty (30) days from the provision of the services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 12 \u2013 Right of withdrawal<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium where performance has begun after the consumer\u2019s prior express consent and express waiver of the right of withdrawal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By validating the purchase of a Bloom &amp; Fly subscription via the App Store or Google Play Store, the Client acknowledges and accepts, in accordance with the subscription flow of the relevant platform, that access to the service begins immediately after payment validation and expressly waives their right of withdrawal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any refund request is subject exclusively to the refund policy of the distribution platform used and must be made directly with that platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 13 \u2013 Liability<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps is bound by an obligation of means in the provision of the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps shall not be held liable for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>temporary interruptions of the service due to maintenance, updates or technical causes beyond its control,<\/li>\n\n\n\n<li>malfunctions attributable to the Apple App Store or Google Play Store platforms,<\/li>\n\n\n\n<li>the Client\u2019s use of the content provided.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Bloom &amp; Fly service does not constitute a medical service and does not replace medical advice, diagnosis or treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 14 \u2013 Digital service conformity<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps undertakes to provide a digital service that complies with its description and the essential features presented in the application at the time of subscription.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a lack of conformity, the Client is invited to contact Bloomy Apps at\u00a0&nbsp;<a href=\"mailto:contact@bloomandflyapp.com\">contact@bloomandflyapp.com<\/a>&nbsp;in order to allow corrective measures, such as correction, update or restoration of access to the service, within a reasonable period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Service conformity may be affected by external factors, including the Client\u2019s device, operating system version, internet connection quality, or constraints specific to the Apple App Store and Google Play Store platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 15 \u2013 Intellectual property<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All content, trademarks, logos, texts, visuals, sounds and features of the Bloom &amp; Fly application are protected by intellectual property law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any unauthorised reproduction, representation or use is strictly prohibited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 16 \u2013 Personal data<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data collected in connection with use of the service is processed in accordance with applicable regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client may request deletion of their personal data at any time by sending a request by email to&nbsp;<a href=\"mailto:contact@bloomandflyapp.com\">contact@bloomandflyapp.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Full details regarding the exercise of the Client\u2019s rights are set out in the Privacy Policy accessible on the website and within the application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 17 \u2013 Mediation and dispute resolution<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with the provisions of the French Consumer Code, the Client may have recourse free of charge to a consumer mediator in order to seek amicable resolution of a
