These Terms of Use are also accessible on the Site and within the Application (Settings section, then Terms of Use).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>1. Legal information and scope<\/strong><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Site&nbsp;<a href=\"https:\/\/bloomandflyapp.com\/en\/\">www.bloomandflyapp.com<\/a>&nbsp;is published by Bloomy Apps, a simplified joint-stock company (SAS) with a share capital of \u20ac500, whose registered office is located at 604 chemin du Puy, 06600 Antibes, registered with the Antibes Trade and Companies Register under number SIREN 999 896 061.<br>Email address:&nbsp;<a href=\"mailto:contact@bloomandflyapp.com\">contact@bloomandflyapp.com<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Site is hosted by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms of Use apply to the use of the Site and the Bloom &amp; Fly Application. The Site is intended for informational purposes (presentation of the Application, contact form). The Application provides access to well-being and personal development content and features for non-medical purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>2. Definitions<\/strong><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSite\u201d: the website accessible at&nbsp;<a href=\"https:\/\/bloomandflyapp.com\/en\/\">www.bloomandflyapp.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cApplication\u201d: the Bloom &amp; Fly mobile application published by Bloomy Apps, available on iOS and Android.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUser\u201d: any natural person who accesses, browses, or uses all or part of the Site and\/or the Application, whether or not they have created an Account, and regardless of whether they have subscribed to a paid offer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPublisher\u201d: Bloomy Apps, the company that publishes and operates the Site and the Application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAccount\u201d: a personal space created by the User within the Application, enabling identification and access to certain features.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cContent\u201d: digital well-being content offered within the Application (breathing exercises, mantras, sounds, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cServices\u201d: all features, content, and digital services provided by Bloomy Apps through the Site and\/or the Application, whether free or paid, including, in particular, breathing exercises, mantras\/affirmations, chakra and mudra-related content, rituals, guided journeys, as well as sounds and ambient experiences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSubscription\u201d: a paid plan providing access to all premium features and Content currently available in the Application, subscribed to via third-party distribution platforms (App Store and Google Play) in accordance with their respective terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPlatforms\u201d: Apple (App Store) and Google (Google Play), third-party platforms through which the Application can be downloaded and through which Subscriptions can be subscribed to, managed, and canceled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>3. Services Provided<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.1 Site Services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Site provides the User with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>general information about the Bloom &amp; Fly application and its universe; <\/li>\n\n\n\n<li>a registration form allowing users to join the waiting list ahead of the mobile app launch; <\/li>\n\n\n\n<li>a contact form enabling users to submit questions or requests to the Publisher.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Site does not offer online sales, account creation, or access to paid content. These services may be added later and will be subject to specific terms where applicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.2 Application Services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Application allows the User, in particular, to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to create an Account and log in, including via third-party authentication services (Apple, Google, Facebook);<\/li>\n\n\n\n<li>to access free Content and features;<\/li>\n\n\n\n<li>to access, where applicable, premium features depending on the offer available. The features and Content may evolve at any time.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>4. Access to the Site<\/strong> <strong>and the Application<\/strong><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to the Site and the Application is free of charge for any User with Internet access and compatible equipment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All costs related to access to the Site and the Application (Internet connection, hardware, software, etc.) are borne solely by the User.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher strives to provide access to the Site and the Application 24 hours a day, 7 days a week, subject to maintenance operations, updates, or force majeure events. The Publisher shall not be held liable for any temporary unavailability of the Site or the Application, regardless of the cause, including in the event of failures in telecommunications networks, distribution platforms (App Store, Google Play), or the User\u2019s equipment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Use of the Application requires a compatible device and an appropriate version of the operating system. Certain features may depend on the User\u2019s device, settings, or Internet connection. Bloomy Apps does not guarantee that the Application will be compatible with all devices or all versions of operating systems.<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. Access, User Account and Subscription<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.1 User Account, Credentials and Security<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to certain features of the Application requires the creation of an Account. The User agrees to provide accurate information and to keep it up to date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Login credentials are personal. The User is responsible for keeping them confidential and for any use of their Account. In the event of fraudulent use, the User is invited to contact Bloomy Apps at the following address:\u00a0<a href=\"mailto:contact@bloomandflyapp.com\">contact@bloomandflyapp.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The User may also log in via a third-party service (Apple, Google, Facebook), in accordance with the options provided.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The User agrees to use the Site and the Application in accordance with these Terms of Use and applicable laws. In particular, it is prohibited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>attempt to gain unauthorized access to the Publisher\u2019s systems;<\/li>\n\n\n\n<li>disrupt the proper functioning of the Site or the Application (e.g., injection, abusive scraping, reverse engineering, circumvention of security measures);<\/li>\n\n\n\n<li>use the Application in any manner that may infringe upon the rights of third parties or compromise the security of systems.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a serious breach, Bloomy Apps reserves the right to suspend or delete access to the Account, to the extent permitted by applicable regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.2 Subscription and Premium Features (via App Store \/ Google Play)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Certain features and Content of the Application may only be accessible as part of a Subscription. The Subscription in effect on the date of subscription provides access to all premium features and Content available at that time. Any subsequent changes to features do not give rise to any claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subscription, payment, renewal, and cancellation of the Subscription are handled exclusively by the Platforms (App Store and Google Play), in accordance with their own terms and policies. The User is invited to review the terms of the relevant Platform to understand the applicable conditions (pricing, duration, automatic renewal, cancellation, and any potential refunds).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bloomy Apps does not have access to the User\u2019s payment methods and does not directly handle transactions made through the Platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>6. Personal Data<\/strong><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the context of using the Site and the Application, personal data may be collected and processed, in particular when:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>browsing the Site;<\/li>\n\n\n\n<li>creating and managing a user account within the Application;<\/li>\n\n\n\n<li>using the features offered through the Application;<\/li>\n\n\n\n<li>communicating with the Publisher via contact forms or by email.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Such data may include, depending on the case, first name, last name, email address, the content of exchanged messages, as well as technical data related to the use of the Site or the Application.<br>Personal data is processed in accordance with the General Data Protection Regulation (GDPR \u2013 EU 2016\/679) and applicable laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Full details regarding data collection, purposes, legal bases, retention periods, data recipients, and Users\u2019 rights are set out in the Privacy Policy, available on the Site and within the Application. Intellectual property<\/strong><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All elements present on the Site and within the Application, including texts, visuals, illustrations, logos, trademarks, interfaces, graphic elements, sounds, music, audio content, programs, animations, as well as any other content or component of the Site or the Application, are protected by applicable intellectual property laws. These elements are the exclusive property of the Publisher or are subject to usage or exploitation rights granted to the Publisher.\n\nAny reproduction, representation, adaptation, modification, dissemination, distribution, or use, in whole or in part, of the Site, the Application, or any of their elements, by any means and on any medium whatsoever, without the prior written authorization of the Publisher, is strictly prohibited.\n\nAccess to the Site and the Application grants the User a strictly personal, private, non-exclusive, non-transferable, and non-assignable right of use, limited to the use of the features and content in accordance with these Terms of Use.\n\nAny use of the Site or the Application for the purposes of reproduction, distribution, representation, commercialization, or exploitation of the content, without the prior written authorization of the Publisher, is prohibited and may give rise to liability on the part of the user.\n\nThe recommendation or presentation of the Site or the Application by professionals (including healthcare, wellness, or support professionals), for informational purposes and without exploitation of the content, is permitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mere mention, reference, or promotion of the Site or the Application, without reproducing protected content, is permitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>8.
